I am a hard working law abiding citizen of this community; I work hard to provide a home, food and a good future for my family. I have a property in Walter Street, West Bromwich which I rent out as an investment for my children’s future. On 4th June 2011 the short term tenancy agreement on that property came to an end and I informed the tenants that I would not be renewing their contract and require possession of my property. In compliance with the law I issued them a section 21 giving them 2 months to find alternative residence and vacate my property by 4th August 2011. On the 4th August the tenants were packed and ready to go but then refused to move out of the property stating that the local council has advised them that they have tenants rights, the right to stay in my property because they are homeless and if they move out they will not be eligible for a council house, despite not paying any rent since 2nd July 2011, leaving me to pay the £500 mortgage per month.

However the statutory guidance issued by Department of communities and local government makes clear that a person does not need to be subject to a court possession order in order to be statutorily homeless"
They are telling them to technically to become sitting tenants. Waiting for a possession order to be batted back and forth to them in order for them to do something about it. Another bad example of bureaucracy and manipulation of the law in order to gain a council property at my extreme expense. What about my rights? Who is going to cover my monthly mortgage costs? With respect where is the law? This person is living in my house, rent free, without regard for the rightfully owner and I am being forced to pay further court costs and face lengthy court hearings to regain possession of my own property. This is absolutely unacceptable and raises some grave concerns about morality and fairness in our society. Raising serious concerns in our justice system and law.
The law says tenants have the right to reside because they will be homeless and have nowhere to live.
The law says landlords are breaking the law if they try to change the locks and put belongings outside and cannot take the law into their own hands by removing squatters from their property. Forcing landlords to face further financial hardships when a breach occurs by having to pay court fees for repossession orders, solicitor’s fees and court costs when tenants are determined to flaunt the legislation. What happened to morals and where are the boundaries between right and wrong?
The property is mine, the name on the deeds is mine, the mortgage agreement is on my name and yet the law states that if I fall behind with my mortgage repayments the bank can repossess my house but allows someone else who is not paying for it, nor owns it, to live in it until I am forced to take them to court. Then they can be allowed to live in it rent free for up to 6 months. This is what is wrong with society; hardworking, law abiding citizenship is not recognized but a culture of ruthless bureaucracy and lack of responsibility is completely acceptable. We hereby request that government look into tenancy laws and change the law to protect law bidding and hardworking citizens of the community to restore sensibility, law and order. Give me justice for what is rightfully mine!!!!
